A Koh Samui condo ad may look simple, but the ownership wording matters. Freehold Thai quota, freehold foreigner quota and leasehold can describe similar looking units, but they are very different legal structures.
THE 49% CONDO RULE. WHAT YOU ACTUALLY OWN- LAND INCLUDED
Foreigners can own a Thai condo 100% freehold in their own name, but only within the building’s 49% foreign ownership quota. The quota is based on floor area, not the number of units, and the condo title also includes a share of common property, including the land beneath the building.
